1. About Pocket Mentor

Pocket Mentor is an AI-powered personal development and coaching tool designed to support reflection, wellbeing, personal growth, emotional awareness, and behavioural insight. It provides general information and guidance only.

Pocket Mentor does not provide:

• medical or psychological advice
• diagnosis, treatment, or therapy
• legal, financial, or professional advice
• real-time or emergency support

You are responsible for your own decisions and actions.

If you are in an emergency or feel unsafe, call 999 immediately (UK). For crisis support, contact the Samaritans on 116 123.

2. Consumer Law

Nothing in these Terms excludes or modifies any consumer rights under the Consumer Rights Act 2015.

Where permitted, our liability is limited to:

• resupplying the Service, or
• covering the cost of re-supplying the Service.

3. Eligibility

You must:

• be 18 years or older
• have the legal capacity to enter into these Terms
• use the Service only for personal, non-commercial purposes unless approved by us

People under 18 may not use the Service.

4. Account Registration

If you create an account, you agree to:

• provide accurate and current information
• keep your login details secure
• notify us of any unauthorised access

Pocket Mentor may suspend or terminate accounts that breach these Terms.

5. Acceptable Use

You must not:

• use the Service for illegal, harmful, threatening, or abusive purposes
• harass, harm, or endanger others
• submit content that is defamatory, infringing, explicit, discriminatory, or inappropriate
• use the Service to provide professional advice
• attempt to manipulate, disrupt, exploit, or reverse-engineer the AI systems
• encourage self-harm or harm to others

We may restrict, remove, or disable content or accounts at our discretion.

6. Use of Artificial Intelligence (OpenAI Enterprise)

Pocket Mentor uses OpenAI's ChatGPT Enterprise platform to generate responses.

By using the Service, you acknowledge that:

1. Your prompts, messages, and data may be processed by OpenAI to generate responses.
2. Under OpenAI Enterprise policies:
   • User data is not used to train OpenAI's models.
   • Data is not shared with other customers.
   • Data may be retained temporarily for safety, security, and system functioning.
3. AI responses may be inaccurate, incomplete, or inappropriate.
4. AI does not replace clinical, professional, or therapeutic care.
5. No human reviews your conversations unless legally required or for safety/security investigations.

Users cannot opt out of Pocket Mentor's internal AI model improvement processes, which are used solely to enhance the performance of the Pocket Mentor platform, not OpenAI's models.

You remain responsible for your interpretation and use of AI-generated content.

7. No Clinical, Medical, or Crisis Support

Pocket Mentor is not:

• a medical device
• a mental health treatment service
• a diagnostic or therapeutic tool

The Service cannot detect emergencies, monitor your wellbeing in real time, or guarantee timely responses.

If you feel unsafe or in crisis:

8. User Content

"User Content" includes any prompts, text, reflections, audio, journal entries, goals, or data you provide.

You grant Pocket Mentor a non-exclusive, royalty-free, worldwide licence to use User Content for:

• providing the Service
• improving features and performance
• ensuring system safety and integrity
• internal AI refinement and quality assurance

Pocket Mentor does not sell your personal information.

You represent that your content does not infringe the rights of others.

9. Special Category Information

You may provide information related to mental health, personal wellbeing, emotions, or personal history.

By using the Service, you consent to Pocket Mentor:

• collecting, storing, and processing such information
• using it for the purposes of the Service
• handling it in accordance with the Data Protection Act 2018 and our privacy policy.

10. Privacy & International Data Transfers

Pocket Mentor's data practices are outlined in the Pocket Mentor Privacy Policy, which forms part of these Terms.

We may store or process personal information using third-party service providers, including:

• AWS (cloud infrastructure & hosting)
• Mailchimp (email & communication)
• Stripe (payment processing)
• Apple App Store & Google Play (in-app purchases)
• OpenAI (AI processing)

These providers may store data in Australia, the United States, or other jurisdictions.

By using the Service, you consent to international data transfers as described in our privacy policy.

11. Security

Pocket Mentor uses technical and organisational measures that are reasonable in the circumstances, to protect your personal information including:

• encrypted data transmission
• controlled access
• secure hosting environments
• industry-standard vendor protections

However, no system is completely secure. You use the Service at your own risk.

12. Data Retention

We retain personal and account data:

• as long as necessary to operate the Service
• to comply with legal obligations
• until you request deletion (where lawfully permitted)

Backups may persist for a limited period after a request for deletion.

13. Subscription, Billing & Refunds

Some features require a paid subscription.

13.1 Payments

Payments are processed through:

• Apple App Store
• Google Play Store
• Stripe

Their terms relating to payment, billing, cancellations, and refunds are in addition to these terms. Any changes to taxation applicable to the provision of the services will be passed on to you.

You can cancel your subscription at any time but may not be entitled to a refund for the remainder of the subscription period.

13.2 Automatic Renewal

Subscriptions renew automatically unless cancelled at least 24 hours prior to the renewal date.

Once per year, you will be reminded that the subscription continues to renew and you will be entitled to a further cooling-off period. Charges will be similarly pro-rated during the renewal cooling-off period as during the first cooling-off period.

13.3 Refunds

Refunds should be requested through Apple, Google, or Stripe, depending on where the purchase was made.

14. Third-Party Services

The Service may integrate with, rely on or suggest third-party platforms.

Unless we are negligent, Pocket Mentor is not responsible for:

• third-party content
• third-party security
• downtime or errors
• changes to their terms

Use them at your own discretion.

15. Intellectual Property

All content, software, designs, branding, and AI logic are owned by Pocket Mentor AI Pty Ltd or licensed to us.

You must not:

• copy or reproduce the Service
• distribute or publicly display content
• reverse-engineer the platform
• misuse trademarks

16. Data Loss & Backup

Pocket Mentor is not responsible for:

• loss of personal reflections, journals, or entries
• device failure
• accidental deletion

Users should maintain their own backups where required.

17. Behavioural & Decision-Making Disclaimer

Pocket Mentor:

• does not guarantee performance, behavioural, or wellbeing outcomes
• does not ensure improvement in mental or emotional state
• does not replace professional or personal judgment

You remain responsible for your decisions.

18. Service Changes

We may update or discontinue features or functionality at any time, as long as the Services still meet their original description.

If we make changes to the price of the Services or features or functionality of the Services that materially changes the description of the Services, then you shall be entitled to cancel the subscription for a pro-rata refund.

We may also update these Terms periodically. Continued use constitutes acceptance of updates.

19. Termination

We may suspend or terminate your access if:

• you breach these Terms
• you misuse the Service
• your actions create safety or security risks
• we discontinue the Service

You may terminate your account at any time.

20. Other important terms apply to our contract

• Disputes will be governed by the laws of England and Wales, and resolved exclusively in the courts of England and Wales.
• We can transfer our contract with you, so that a different organisation is responsible for supplying the Services.
• You cannot transfer your subscription to another person unless we agree.
• If a court invalidates some of this contract, the rest will apply.
• Nobody else has any rights under this contract.
• Even if we delay in enforcing this contract, we can still enforce it later.

21. Governing Law

These Terms are governed by the laws of England and Wales.
